Peano Mobile reserves the right to temporarily or permanently stop, maintain, or modify our Services for the following reasons:

  • Technical issues including server problems, hardware/software malfunctions, or security incidents
  • Updates to improve our Services and user experience
  • Legitimate concerns regarding privacy, content, or service maintenance
  • Commercial reasons for discontinuing a service
  • Changes to services we provide

Service Limitations

We do not guarantee uninterrupted service availability. Our Services may experience:

4. User Content and Copyright

  • All other content (graphics, UI design, etc.) belongs to Peano Mobile

5. User Conduct and Community Guidelines

Prohibited Activities

You agree not to engage in any of the following activities:

  • Not contain explicit, adult, or inappropriate material

6. Age Restrictions and Parental Consent

Our Services are intended for users who are 18 years of age or older. If you are between 13 and 17 years old, you may only use our Services with the explicit consent and supervision of a parent or legal guardian. Users under 13 are not permitted to use our Services under any circumstances. Parents and guardians are responsible for monitoring and controlling their minor children's use of our Services.

Peano Mobile and its Services, including but not limited to software, graphics, logos, designs, page headers, button icons, scripts, and service names, are the property of Peano Mobile or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our intellectual property without explicit written permission.

Digital Millennium Copyright Act (DMCA)

We respect intellectual property rights and respond to valid DMCA takedown notices. If you believe your copyrighted work has been infringed, please provide:

  • Your physical or electronic signature
  • Identification of the copyrighted work claimed to be infringed
  • Location of the allegedly infringing material
  • Your contact information
  • A statement of good faith belief that the use is not authorized
  • A statement of accuracy and authority to act on behalf of the copyright owner

8. Platform-Specific Terms

iOS App Store Terms

If you download our app through the Apple App Store, you acknowledge that these Terms are between you and Peano Mobile, not Apple. Apple is not responsible for our app or any claims related to it. You must comply with Apple's App Store Terms of Service when using our iOS application.

Google Play Store Terms

If you download our app through Google Play, you acknowledge that these Terms are between you and Peano Mobile, not Google. Google is not responsible for our app or any claims related to it. You must comply with Google Play's Terms of Service when using our Android application.

9. Beta Testing and Feedback

We may invite you to test beta versions of our Services. Beta features are provided "as-is" and may contain bugs or incomplete functionality. By participating in beta testing, you agree to provide feedback and acknowledge that beta features may be changed or removed without notice. Any feedback you provide becomes our property and may be used to improve our Services without compensation to you.

10. API Usage and Developer Terms

If we provide APIs or developer tools, additional terms may apply:

Arbitration Agreement

Any disputes that cannot be resolved informally will be settled through binding arbitration rather than court proceedings, except where prohibited by law. 19. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the jurisdiction where Peano Mobile is incorporated, without regard to conflict of law principles. Any legal proceedings that are not subject to arbitration will be conducted in the courts of that jurisdiction, and you consent to the jurisdiction of such courts.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. We will replace any invalid provision with a valid provision that most closely approximates the intent and economic effect of the original provision.

21. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and Peano Mobile regarding your use of our Services. These Terms supersede all prior or contemporaneous understandings and agreements, whether written or oral, regarding the Services.

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

23. Survival

Provisions of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property rights, limitation of liability, indemnification, dispute resolution, and governing law provisions.

24. Paid Services and Subscriptions

Subscription Information

  • Some services require paid subscriptions
  • Subscriptions auto-renew unless cancelled 24+ hours before renewal
  • Charges occur 24 hours before current period ends
  • Subscriptions cannot be transferred to third parties

Payment Terms

  • Additional paid features may be available through in-app purchases or website payments
  • You are responsible for understanding payment terms for in-app purchases
  • All payments are final and non-refundable
  • Pricing may vary based on promotions, loyalty bonuses, and user activity

25. Account Termination

Your Rights

You may delete your profile, uninstall the mobile application, or cancel subscriptions at any time.

Our Rights

We may limit or restrict access to our Services without notice for users who:

  • Violate chat rules or community guidelines
  • Breach this User Agreement
  • Provide prohibited content as outlined in this agreement

Restrictions may include account suspension, registration cancellation, or IP address blocking. We may use software, technical, legal, and other means to enforce these terms. Subscriptions remain valid until manually cancelled, even if access is restricted.

26. Abuse and Complaints

Report incidents of abuse, rule violations, or copyright infringement through our contact methods. Users who attempt to resolve disputes by violating our rules or taking illegal actions may have their access restricted temporarily or permanently.

27. Limitation of Liability

General Limitations

  • We are not responsible for actions taken by users or content they provide
  • We do not accept liability for lawsuits, penalties, claims, damages, or expenses of any nature
  • This includes direct, indirect, incidental, penalty damages, and losses from negligence
  • Coverage includes service interruption, data loss, hardware damage, virus attacks, income loss, and business interruption

Technical Issues

We are not liable for transmission of software, viruses, hardware malfunctions, communication issues, unauthorized access, theft, operator errors, strikes, or force majeure events. This includes loss of income, profits, contracts, business, anticipated savings, goodwill, data, or any other damages.

User Indemnification

You agree to protect Peano Mobile and its employees from third-party claims and associated costs resulting from your actions while using our Services or content you provide.

28. Amendments and Updates

We reserve the right to amend our guidelines, Privacy Policy, and this Agreement without prior notification. Key points:

  • Current versions are published on our website
  • Amendments become effective immediately upon publication or from indicated start dates
  • While we may notify users of changes, it is your responsibility to check for updates regularly
  • Continued use after amendments indicates agreement with updated terms
  • If you disagree with any terms, you should stop using our Services immediately
